A boundary dispute arises between owners/occupiers of neighbouring properties when one party constructs a fence, wall, or building in a position where another property has a different view of where the boundary lies.
Legal documentation at the time of purchasing your property would outline the boundaries of your property. Boundary disputes can often be disproportionately costly, but we are highly effective at Dispute Resolution and can often avoid a dispute from becoming a legal conflict.
An Expert Witness can provide a court with a statement of opinion on any admissible matter calling for expertise by the witness, providing they are qualified to give such an opinion.
Examples include;
- inspecting new build homes for defects and poor workmanship, including breaches of NHBC guidelines,
- assessing water ingress and dampness issues following construction work and alterations,
- assessing cracking and settlement following construction work and alterations,
- issues in relation to ground movement following construction work.
This survey records the condition of building components and systems down to minor wear and tear. It is an ideal survey to have prior to letting or terminating a contract to validate contractors’ performance.
A well-prepared Schedule of Condition will limit tenants repairing liability at lease termination, wherever a lease places repairing obligations upon a tenant. This can be for residential or commercial leases.
If part of a property has been sold or the boundary has been moved, a new plan showing the new layout will be needed for any future convenance.
These need to be to a prescribed scale and format to comply with Land Registry rules.
